1. Service Offer
1.1. The "Blue Whale VR Café" is an offering of Redel & Redel GbR, Theaterstr. 20 in 52062 Aachen (hereinafter referred to as the "Operator").
1.2. As part of the "Blue Whale VR Café", the Operator provides the contracting parties ("Guests") with the opportunity to experience the latest virtual reality technology ("VR technology") through games and entertainment applications.
1.3. The Operator offers the services of the Blue Whale VR Café exclusively under these terms and conditions. The inclusion of the general terms and conditions of Guests is expressly rejected.
2. Reservations and Cancellations
2.1. Reservations can be made via the Blue Whale VR Café website or by phone. A reservation becomes legally binding by clicking the button "Reserve for a fee" or "Book and pay" or by making a reservation by phone. By submitting the reservation or making it via phone, the contract for the use of the Blue Whale VR Café comes into effect. The Operator will confirm the receipt of the reservation by email to the provided address.
2.2. Reservations can be canceled free of charge up to 14 days before the respective date. If the amount has already been charged, it will be refunded using the same payment method.
2.3. For reservations that are paid on-site, the guest is required to arrive no later than 30 minutes before the start of the game and pay for their tickets. Otherwise, the game time may be shortened or the start time may be postponed. If the guest does not show up, they will be charged the cancellation fee according to point 2.4.
2.4. If a reservation is canceled later than 14 days before the respective date, the operator retains their entitlement to compensation. However, they will credit any savings or other income they have gained. The operator is entitled to withhold the total amount of the booked games as a cancellation fee. The guest may provide evidence of significantly higher savings or significantly higher alternative income.
2.5. As far as the booking situation allows, the operator may check in cases of item 2.4 whether and to what extent a rebooking to a date within 14 days from the booking date is possible, taking into account the payments already made. However, the operator is not obligated to do so.
2.6. For a group size of 5 persons or more than 2 game rounds, or in the case of reservations made by companies, a reservation is only possible with advance payment.
2.7. The operator is entitled to withdraw from a reservation if:
• there are inquiries from other guests for the same period and the already reserved guest does not make an advance payment despite the inquiry,
• if they are prevented from providing the service due to force majeure or other reasons,
• or if a registration was made with false or misleading information, where the identity or the age of the guests may be significant.
In cases of force majeure, any advance payments will be converted into vouchers. In other cases, advance payments will be refunded using the same payment method.
2.8. Discounts, offers, and exclusive reservations cannot be combined.
3. Vouchers and Right of Withdrawal
When purchasing vouchers on blauwalvrcafe.de , the buyer has a 14-day right of withdrawal. If the voucher purchase is to be withdrawn, the buyer must send an informal email with the withdrawal request and the relevant voucher code to [email protected] . The voucher amount will then be refunded using the same method that was used for payment. A prerequisite for this is that the voucher has not been used or redeemed in the meantime.
4. Youth Protection and Age Rating
4.1. The operator is entitled to verify the age information of the guest using a public identification document (ID card, passport, driver's license). If age verification is not possible for all guests, the operator is entitled to make only those games and multimedia applications accessible that do not have age restrictions or are approved for ages 6 and up.
4.2. Games or multimedia applications with a higher age rating may be made available if accompanying parents or guardians are present with the underage guest or if their informal written permission is provided; however, the operator is not obligated to do so.
4.3. No refund of the reservation will be made if certain desired games of the guests cannot be provided due to age ratings.
5. Exclusion of Use
5.1 The operator reserves the right to exclude individuals from using the Blauwal VR Café on a case-by-case basis if they are intoxicated or have consumed other consciousness-altering drugs. This also applies in cases where individuals behave disruptively loud despite repeated warnings, negatively affecting the experience of other guests, or if individuals behave aggressively, xenophobically, provocatively, or in any other way that is inappropriate towards the staff or other guests while using the Blauwal VR Café. Advertising for political parties, religions, or other ideologies in the premises of the Blauwal VR Café is also not permitted.
5.2. VR technology is a young technology that is constantly evolving. The Blauwal VR Café uses the latest technology, and over 99.5% of guests have no symptoms. However, just like with other screen applications, it is not excluded that using VR technology may lead to dizziness, nausea, visual disturbances, eye pain, disorientation and consciousness disturbances, headaches, and even epileptic seizures. If you have a known pre-existing condition, it is advised against using the Blauwal VR Café.
5.3 For most guests, there are no feelings of dizziness due to the latest technology and the particularly careful selection of games. If such feelings are known from previous use, it is recommended to inform the staff upon entry. They will then recommend appropriate measures and pay special attention to the selection of games. If symptoms do occur during use, it is strongly advised not to continue using the VR technology immediately. It is recommended to take a break after about 1-1.5 hours of gameplay.
5.3. A refund due to limited or non-use for reasons stated in sections 5.1 or 5.2 will only occur according to the rules of section 2.
6. Liability
6.1. Claims for damages by guests are generally excluded, unless otherwise provided below. Excluded from this are claims for damages by guests arising from injury to life, body, health, or from the violation of essential contractual obligations (cardinal duties) as well as liability for other damages that are based on intentional or grossly negligent breaches of duty by the operator, its legal representatives, or agents. Essential contractual obligations are those whose fulfillment is necessary to achieve the purpose of the contract.
6.2. In the event of a violation of cardinal duties, the operator is only liable for typical, foreseeable damages if caused by simple negligence, unless it concerns claims for damages by the user arising from injury to life, body, or health.
6.3. Guests' claims for damages instead of performance are excluded, especially in cases of clause 2.7.
6.4. The limitations on guests' claims also apply in favor of the legal representatives and agents of the operator when claims are made directly against them.
7. Visual materials, beverages, food
7.1. The creation and distribution of photo and video recordings in the Blue Whale VR Café by guests is permitted and encouraged.
7.2. Photo and video recordings made by the operator of guests in the Blue Whale VR Café may be published, distributed, and used indefinitely for the operator's self-promotion.
7.3. The consumption of food and beverages brought from outside is generally not permitted, except for special offers from the operator.
8. Miscellaneous
8.1. German law applies.
8.2. Should individual clauses be wholly or partially ineffective or incomplete, this does not affect the validity of the remaining contractual conditions.
8.3. Insofar as the guest is a merchant, public law special fund, or legal entity under public law, Aachen is agreed as the exclusive place of jurisdiction.
